1. Introduction


These Terms and Conditions (“Terms”) govern the rental and use of phototherapy blankets (“Equipment”) provided by Phototherapy Perth (“we,” “our,” “us”). By hiring our Equipment, you (“Customer,” “you”) agree to comply with these Terms.

2. Medical Disclaimer


• Our Equipment is provided only for the treatment of neonatal jaundice as directed by a qualified healthcare professional.
• Phototherapy Perth does not provide medical advice.
• You must obtain and follow instructions from your baby’s healthcare provider before and during Equipment use.
• If your baby’s condition worsens, if you are concerned, or if your baby shows signs of illness (such as poor feeding, lethargy, or difficulty breathing), you must present immediately to the Emergency Department of your nearest hospital or contact your doctor.

3. Rental Period


• The rental period begins on the date the Equipment is collected from our office in Murdoch and continues until it is returned to us.
• Extensions are subject to availability and additional rental fees.

4. Fees and Payment


• Rental fees are payable in advance at the time of booking or collection.
• A refundable security bond may be required.
• Late returns will incur additional daily charges.

5. Collection and Return


• All Equipment must be collected from and returned to our Murdoch office at the agreed times.
• Customers are responsible for safe transport of the Equipment to and from their home.
• Failure to return equipment on time may result in additional charges.

6. Customer Responsibilities


The Customer agrees to:

1) Use the Equipment only as directed by a healthcare provider and in accordance with the instructions provided.
2) Ensure the equipment is used in a safe, clean, smoke-free environment.
3) Keep the Equipment in good condition and return it by the agreed date.
4) Not tamper with, modify, or attempt to repair the Equipment.
5) Immediately notify us if the Equipment is not functioning properly.

7. Damage, Loss, or Theft


• Customers are responsible for the equipment while in their possession.
• If the Equipment is lost, stolen, or damaged beyond normal wear and tear, the Customer will be liable for repair or replacement costs.
• The minimum replacement value of the Equipment is $6,000.00 (AUD).

8. Cleaning and Infection Control


• All Equipment is cleaned and sanitised to medical-grade standards before each hire.
• Customers must not attempt to sterilise or deep-clean the equipment themselves beyond routine surface cleaning as instructed.

9. Liability


• To the maximum extent permitted by law, Phototherapy Perth is not liable for any injury, loss, or damage resulting from the use or misuse of the Equipment.
• Nothing in these Terms excludes or limits rights under the Australian Consumer Law.

10. Termination of Hire


We reserve the right to terminate the rental and require immediate return of the Equipment if the Customer breaches these Terms or misuses the Equipment.

11. Privacy


• Personal information is collected only to manage bookings, process payments, provide equipment, and comply with safety requirements.
• Information is handled in accordance with the Australian Privacy Principles.

12. Governing Law


These Terms are governed by the laws of Western Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.
